Terms of Use

Effective Date: September 17, 2026

Last Updated: September 17, 2026

Welcome to ChoosingCharter. These Terms of Use govern your access to and use of ChoosingCharter.com, our applications, school profiles, matching tools, dashboards, communications, and related services collectively referred to as the “Services.”

ChoosingCharter is operated by Hyve Holdings LLC, referred to in these Terms as “ChoosingCharter,” “we,” “us,” or “our.”

By accessing or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.

1. About ChoosingCharter

ChoosingCharter helps parents and guardians discover, research, compare, and connect with charter schools based on information such as:

  • Student grade level
  • Location and distance
  • Academic programs
  • Extracurricular activities
  • Learning environment
  • Transportation and family logistics
  • Student-support preferences
  • Enrollment information
  • School events
  • Other priorities selected by the family

ChoosingCharter may also provide schools with profiles, inquiry-management tools, event promotion, analytics, and enrollment-related services.

ChoosingCharter is an independent information and technology platform. Unless expressly stated otherwise, we are not a school, school district, charter authorizer, government agency, admissions office, educational consultant, or enrollment decision-maker.

2. Eligibility

You must be at least 18 years old and legally capable of entering into a binding agreement to create an account or use account-based features.

Parents and guardians may provide information about a child for the purpose of finding and evaluating schools. Children may not independently create accounts or submit personal information through the Services.

School accounts may only be created or controlled by people authorized to act for the applicable school or charter organization.

3. Parent and Guardian Accounts

When creating a parent account, you agree to:

  • Provide accurate and current information.
  • Maintain the security of your login credentials.
  • Provide information about a child only when you are authorized to do so.
  • Review school information and important enrollment requirements directly with the school.
  • Notify us promptly if you believe your account has been compromised.

You are responsible for activities conducted through your account.

4. School and Organization Accounts

If you claim or manage a school profile, you represent that:

  • You are authorized to act on behalf of the school or organization.
  • Information you submit is accurate and not misleading.
  • You have the necessary rights to upload logos, photographs, videos, documents, and other materials.
  • You will keep enrollment information, events, deadlines, programs, and contact details reasonably current.
  • You will use parent information only for legitimate enrollment-related purposes and in compliance with applicable law.
  • You will not sell, disclose, or repurpose parent information for unrelated purposes.

We may request documentation to verify your authority to manage a profile. We may suspend or remove access if authorization cannot be confirmed.

5. School Information and Accuracy

School information may come from:

  • Schools and authorized school representatives
  • Charter organizations
  • Government and public-school databases
  • School websites
  • Charter authorizers
  • Publicly available records
  • Third-party data providers
  • ChoosingCharter research
  • Community or user submissions

Although we work to provide useful and accurate information, school programs, enrollment availability, deadlines, events, transportation, eligibility requirements, and other details may change.

ChoosingCharter does not guarantee that every profile is complete, current, or error-free. Parents should verify important information directly with the school before making enrollment or educational decisions.

A “Verified” or “School Verified” designation means that specified information has been reviewed or confirmed through the applicable verification process. It does not constitute an endorsement, accreditation, ranking, or guarantee of educational quality.

6. Matching Results

ChoosingCharter may generate a match score or recommendation based on information submitted by a parent and information available about participating schools.

Match results:

  • Are informational and comparative tools.
  • Are not professional educational advice.
  • Do not represent a determination that a school is suitable for every student.
  • Do not guarantee admission, enrollment, academic performance, student satisfaction, or any other outcome.
  • May be affected by incomplete, outdated, or unavailable school information.

Parents remain responsible for evaluating schools and making final educational decisions.

7. Inquiries and School Communications

When you select an action such as:

  • Request Information
  • Request a Tour
  • Register for an Event
  • Ask the School to Contact Me
  • Begin an Application
  • Submit another school-contact request

you authorize ChoosingCharter to transmit the information reasonably necessary to fulfill that request to the selected school or organization.

Submitting an inquiry through ChoosingCharter is not the same as submitting an official application unless the Service clearly states otherwise.

ChoosingCharter does not control whether or when a school responds.

8. Communications

By providing your contact information, you agree that ChoosingCharter may contact you regarding:

  • Your account
  • School matches
  • Saved schools
  • Requested information
  • Events and reminders
  • Enrollment deadlines
  • Changes to school information
  • Customer service
  • Security and administrative notices

Marketing email may be discontinued using the unsubscribe link included in the message.

SMS messages will only be sent where appropriate consent has been obtained. Message and data rates may apply. Consent to receive promotional SMS messages is not a condition of using ChoosingCharter.

9. School Events and Calendar Information

ChoosingCharter may display open houses, tours, information sessions, application deadlines, lottery dates, orientations, and other events.

Calendar exports and reminders are provided for convenience. Users should confirm event details directly with the school.

ChoosingCharter is not responsible for missed, changed, postponed, or canceled events or deadlines.

10. Subscriptions and Paid Services

Some school features may require a paid subscription or separate agreement.

Pricing, included features, billing frequency, renewal terms, and cancellation instructions will be disclosed before purchase.

If a subscription automatically renews:

  • The renewal terms will be presented before purchase.
  • The authorized payment method may be charged at the beginning of each renewal period.
  • The subscription may be canceled through the account settings or the cancellation method presented at purchase.
  • Cancellation normally takes effect at the end of the current paid period unless otherwise stated or required by law.

Fees are nonrefundable except when required by law or expressly stated in the applicable order, promotion, or subscription terms.

Payment processing may be provided by a third-party payment processor. ChoosingCharter generally does not retain complete payment-card information.

11. Acceptable Use

You may not:

  • Provide false, deceptive, or misleading information.
  • Impersonate another person, school, or organization.
  • Claim a school profile without authorization.
  • Use parent information for unrelated solicitation.
  • Scrape, harvest, copy, or systematically extract platform data without written permission.
  • Attempt to gain unauthorized access to an account or system.
  • Upload malware or harmful code.
  • Interfere with platform security or operation.
  • Use the Services to discriminate unlawfully.
  • Send spam or unauthorized commercial messages.
  • Violate intellectual-property, privacy, publicity, or other legal rights.
  • Use the Services for unlawful or fraudulent activity.
  • Reverse engineer the Services except where such restrictions are prohibited by law.

We may investigate suspected violations and suspend or terminate access.

12. User Content

“User Content” means information, text, images, videos, school materials, reviews, messages, and other content submitted to the Services.

You retain ownership of your User Content. By submitting it, you grant ChoosingCharter a nonexclusive, worldwide, royalty-free license to host, store, reproduce, format, display, and distribute it as reasonably necessary to operate, improve, and promote the Services.

You represent that you have the rights and permissions necessary to submit the content.

We may remove content that violates these Terms, infringes another person’s rights, creates risk, or is otherwise inappropriate for the Services.

13. Intellectual Property

The Services, including the ChoosingCharter name, branding, software, designs, databases, matching methodology, graphics, text, and original content, are owned by ChoosingCharter or its licensors and are protected by applicable intellectual-property laws.

These Terms grant you a limited, revocable, nonexclusive, nontransferable right to use the Services for their intended purposes.

No ownership rights are transferred to you.

School names, logos, and related materials may belong to their respective owners.

14. Copyright Complaints

If you believe content on ChoosingCharter infringes your copyright, send a notice to:

Email: hello@choosingcharter.com

Mail: Hyve Holdings LLC, 2082 Michelson Dr. Suite 100, Irvine, CA 92612

Your notice should identify the copyrighted work, the allegedly infringing material, your contact information, a good-faith statement, and a statement made under penalty of perjury that the information is accurate and that you are authorized to act.

15. Third-Party Services

The Services may link to school websites, application systems, calendars, maps, payment processors, social networks, and other third-party services.

ChoosingCharter does not control those services and is not responsible for their content, availability, security, accessibility, or privacy practices. Your use of a third-party service is governed by that provider’s terms and policies.

16. No School or Government Endorsement

The appearance of a school on ChoosingCharter does not mean the school:

  • Created or claimed its profile
  • Participates in ChoosingCharter
  • Endorses ChoosingCharter
  • Has approved every item displayed
  • Has availability in any particular grade

Similarly, ChoosingCharter’s use of public school information does not imply endorsement by a government agency, district, or charter authorizer.

17. Disclaimer of Warranties

To the fullest extent permitted by law, the Services are provided “as is” and “as available.”

ChoosingCharter disclaims implied warranties of merchantability, fitness for a particular purpose, title, and noninfringement.

We do not warrant that:

  • The Services will always be available or error-free.
  • School information will always be complete or current.
  • A school will respond to an inquiry.
  • A student will be admitted or enrolled.
  • A match result will produce a particular educational outcome.

Nothing in these Terms excludes warranties that cannot lawfully be excluded.

18. Limitation of Liability

To the fullest extent permitted by law, ChoosingCharter and its owners, officers, employees, contractors, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from the Services.

Our aggregate liability relating to the Services will not exceed the greater of:

  • The amount you paid ChoosingCharter during the 12 months preceding the event giving rise to the claim; or
  • $100.

These limitations do not apply where prohibited by law.

19. Indemnification

To the extent permitted by law, you agree to indemnify and hold ChoosingCharter harmless from claims, losses, liabilities, and reasonable expenses arising from:

  • Your misuse of the Services.
  • Your violation of these Terms.
  • Content you submit.
  • Your violation of another person’s rights.
  • For school users, unauthorized or unlawful use of parent information.

20. Suspension and Termination

You may stop using the Services at any time.

We may suspend or terminate access when reasonably necessary to:

  • Protect users or the platform.
  • Investigate suspected fraud or misuse.
  • Enforce these Terms.
  • Comply with law.
  • Address nonpayment.
  • Protect another person’s rights.

Provisions that logically should survive termination will remain effective.

21. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.

Unless applicable law requires otherwise, disputes relating to these Terms or the Services will be brought in the state or federal courts located in Orange County, California, and each party consents to those courts’ jurisdiction.

22. Changes to These Terms

We may update these Terms periodically. The updated version will be posted with a revised “Last Updated” date.

If changes are material, we may provide additional notice through the Services or by email. Continued use after the effective date of an update constitutes acceptance of the revised Terms.
